At the General Assembly 2022 in Gorée, Senegal, the members of Empacta ® decided to erect the Empacta Court:
“We see the need for an independent judgement on all affairs around auditing and administrative affairs worldwide, inside and outside our association. While there are sufficiently developed mechanisms on human rights, tariffs, and all kind of technical standardization, there is no internationally recognized Court for affairs around auditing. Thus the General Assembly decided
in order to find solutions for audit related conflicts inside or outside the association Empacta ® e.V.
to found this Court.
- The Court must consist out of minimum three persons.
The first members of the Court are elected by the General Assembly.
- Court members can be any physical person with good reputation, with good knowledge of the audit profession and the world.Court members are elected for a period of two years.
- After two years, the Court members can resign, however, only under the condition that a new Court member is willing to serve, that the Court accepts the resignation of the old Court member and that the new Court member is accepted by the Court.
- This new member is also obliged to serve for minimum two years.
- The Court decides all questions by majority vote. The Court appoints new members of the Court with simple majority.
- The Court should gather four times a year, once in each quarter.
- The meetings will be announced on www.flying.university
- The Court may decide on matters between members or between those parties who are willing to accept the ruling of the Court.
- The Court is allowed to require a fee for any decision, which must be equal from both sides.
- The Court must keep minutes of his meetings.
- The Court must publish its decisions on the public website of the Association.
- The Court elects a speaker.
- The Court has a right to require expulsion of EMPACTA members or ambassadors (or any other sanction against members or ambassadors) who are not following the rules of the association or the rulings of the Court.
- Court members receive a representation on the corporate website.
- Every EMPACTA member has the right to apply to the Court.
- Against decisions of the Court, no appeal is possible.
- In case, Court members are involved personally into proceedings of the Court, they cannot take part in the decision. In such a case, their mandate will be disabled for this case. The Court may determine a substitute."
